Welcome to OffGrid Wave! The terms "we", "us" and "our" refer to OffGrid Wave. OffGrid Wave operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the "Services"). OffGrid Wave is powered by Shopify, which enables us to provide the Services to you.
The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services.
Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.
By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services.
SECTION 1 - ACCESS AND ACCOUNT
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, and you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase or manage.
To use the Services, including accessing or browsing our online stores or purchasing any of the products or services we offer, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all the information you provide in our stores is correct, current and complete and that you have all rights necessary to provide this information.
You are solely responsible for maintaining the security of your account credentials and for all of your account activity. You may not transfer, sell, assign, or license your account to any other person.
SECTION 2 - OUR PRODUCTS
We aim to provide accurate product descriptions, specifications, and images. Colors and appearance may vary slightly depending on your screen and device settings.
Product availability and descriptions may change. Changes do not remove your rights concerning an order already accepted or a product that does not match its description.
We may discontinue products or limit quantities and delivery regions. Any product-specific restrictions will be disclosed before purchase.
SECTION 3 - ORDERS
When you place an order, you are making an offer to purchase. An automated order confirmation acknowledges receipt of your order and does not, by itself, confirm acceptance or shipment.
We review orders before accepting them. Payments are authorized at checkout and captured manually after review. If we decline or cancel an order, we will notify you and release the payment authorization or refund any payment already captured, as applicable.
To request cancellation, contact support@offgridwave.com promptly. Cancellation eligibility and any product-specific restrictions are described in our Return and Refund Policy and disclosed on the relevant product page before purchase.
Returns and refunds are governed by our Return and Refund Policy, subject to applicable consumer law.
SECTION 4 - PRICES AND BILLING
All prices and transactions are in U.S. dollars (USD), unless expressly stated otherwise. Product prices, discounts, and promotions may change before an order is placed.
The product price applicable to your order is shown when you place it. Applicable taxes, shipping charges, and any other charges we collect are disclosed at checkout before you submit your order.
Payments are authorized at checkout and captured manually after order review, as described in the Orders section.
You agree to provide accurate and current billing, payment, shipping, and contact information. You must be authorized to use the payment method provided.
Any separate promotional terms will be disclosed with the promotion and remain subject to applicable consumer law.
SECTION 5 - SHIPPING AND DELIVERY
Shipping destinations, charges, processing times, and delivery estimates are described in our Shipping Policy and on the relevant product page.
Delivery dates are estimates unless expressly guaranteed. If we cannot ship within the stated timeframe, we will notify you and provide delay, cancellation, and refund options as required by applicable law.
If your order is lost or damaged in transit, contact support@offgridwave.com so we can investigate and arrange an appropriate resolution. Nothing in these Terms limits your mandatory consumer rights.
SECTION 6 - INTELLECTUAL PROPERTY
Content on our website, including text, images, graphics, video, logos, and its design and arrangement, is owned by West Made Products Ltd., doing business as OffGrid Wave, or used with permission from its respective owners. Customer reviews and other submissions remain owned by their authors, subject to the permissions described in the Feedback section.
You may browse our website and save or print information for personal use, including evaluating products and keeping records of your purchases. Other copying, distribution, modification, or commercial use of protected content requires permission from the relevant rights holder, except where permitted by applicable law.
OffGrid Wave branding belongs to West Made Products Ltd. Shopify branding and third-party product names, logos, and trademarks belong to their respective owners. Displaying these materials does not transfer ownership or grant permission to use them beyond what applicable law allows.
SECTION 7 - OPTIONAL TOOLS
Our website may provide access to optional tools or features operated by third-party providers. Where separate provider terms apply, review them before using the tool.
We do not control independently operated third-party tools or guarantee their availability or suitability for your particular needs. Any descriptions or commitments we expressly make about a tool remain subject to applicable law.
We may introduce additional tools or features. These Terms will apply to them, together with any additional terms disclosed before use.
Using a third-party tool does not reduce our responsibilities concerning purchases through OffGrid Wave. Nothing in this section excludes liability that cannot lawfully be excluded or limits your mandatory consumer rights.
SECTION 8 - THIRD-PARTY LINKS
Our website may include links to external websites or resources operated by third parties. These links do not, by themselves, imply our endorsement. We do not control those external websites or guarantee the accuracy of their content.
Before using an external website or purchasing directly from another business, review its terms, privacy practices, and applicable policies. Questions about purchases made directly with that business should be addressed to it.
This section does not reduce our responsibilities for products purchased through OffGrid Wave, including products shipped by third-party suppliers. Nothing in this section excludes liability that cannot lawfully be excluded or limits your mandatory consumer rights.
SECTION 9 - RELATIONSHIP WITH SHOPIFY
OffGrid Wave is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with OffGrid Wave. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and OffGrid Wave, including any injury, damage, or loss resulting from purchased products and services.
You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with OffGrid Wave.
SECTION 10 - PRIVACY POLICY
All personal information we collect through the Services is subject to our Privacy Policy, and certain personal information may be subject to Shopify's Privacy Policy, which can be viewed here. By using the Services, you acknowledge that you have read these privacy policies.
Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve the Services for you. Information you submit to the Services will be transmitted to and shared with Shopify as well as third parties that may be located in other countries than where you reside, in order to provide services to you. Review our privacy policy for more details on how we, Shopify, and our partners use your personal information.
SECTION 11 - FEEDBACK
You retain ownership of reviews and other content you submit. When you submit content for public display through our Services, you grant us a non-exclusive, worldwide, royalty-free license to reproduce and display it in connection with our store and its promotion. We will not alter a review’s meaning or misrepresent your opinion.
Private customer-service messages are not submitted for public display. Personal information is handled in accordance with our Privacy Policy.
Your submissions must reflect your honest experience. You must have the necessary rights to any content you submit and disclose any payment, free product, or other incentive received in connection with a review.
We may remove content containing unlawful material, threats, harassment, another person’s private information, infringement of intellectual property rights, spam, or malware. We will not remove or suppress a review merely because it is negative.
Nothing in these Terms restricts your right to share an honest review or exercise your consumer rights.
SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS
We may correct errors or omissions in product descriptions, prices, promotions, shipping charges, delivery estimates, and availability.
If we discover a material error affecting an order you have placed, we will contact you to explain the error and any proposed correction. We will not increase your order total or substitute a materially different product without your agreement.
We may decline an order before acceptance. After acceptance, any cancellation will be subject to applicable law. If we cancel your order, we will promptly notify you and release any payment authorization or refund any payment collected for the cancelled order.
Nothing in this section limits your mandatory consumer rights or remedies.
SECTION 13 - PROHIBITED USES
You may use the Services only for lawful purposes. You must not:
(a) engage in fraud, impersonation, or other unlawful activity;
(b) infringe another person’s intellectual property or privacy rights;
(c) threaten, unlawfully harass, or abuse another person;
(d) knowingly submit false or misleading information;
(e) send spam, phishing messages, or other deceptive communications;
(f) upload malware or interfere with the operation or security of the Services;
(g) access accounts, systems, or personal information without authorization; or
(h) copy or commercially exploit protected content without permission or another lawful basis.
You must not use automated tools, including bots, scraping tools, or AI agents, to bypass access restrictions, collect personal information without authorization, or disrupt the Services. Ordinary browsing and lawful use of accessibility tools are permitted.
We may suspend or terminate access for violations of this section in accordance with the Termination section and applicable law.
Nothing in this section prohibits honest reviews, lawful criticism, complaints to regulators, or the exercise of consumer rights.
SECTION 14 - AGENTS
14.1 This section ("Agent Terms") applies if you use, allow, enable, or cause the deployment of an Agent to access, use, or interact with any Services. "Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, any person or entity and that can be executed on behalf of or using persons device, without direct supervision.
14.2 No Agent may access, use, or interact with Services unless, at all times, it identifies itself and operates in strict accordance with the requirements in section 14.4 below. In addition, no Agent may access, use, or interact with Services if we have requested that the Agent refrain from accessing, using, or interacting with any service.
14.3 We may limit, including by technical measures, whether and how any Agent accesses, uses, and interacts with Services.
14.4 Agents must: (i) in all HTTP/HTTPS requests, identify that the request is from an Agent and disclose the name of the Agent by including the following in the request's user agent string: "Agent/[agent name]"; (ii) not conceal or obfuscate that any access, use, or interactions are from an Agent, such as by (a) mimicking human behavior and interaction patterns, or (b) completing or circumventing CAPTCHAs or measures intended to distinguish computer use from humans, (iii) respond truthfully to any question or prompt seeking to determine if interactions are coming from a human or a computer, (iv) not circumvent or otherwise avoid any measure intended to block, limit, modify, or control whether and how Agents access, use, or interact with the Services.
SECTION 15 - TERMINATION
We may suspend or terminate your access to the Services if you materially breach these Terms, use the Services fraudulently or unlawfully, or create a security risk. We will provide notice where reasonably practicable, except where immediate action is necessary or notice is prohibited by law.
Termination of access does not automatically cancel an accepted order or remove either party’s obligations concerning existing orders. Any cancellation, outstanding payment, refund, return, or warranty claim remains subject to the applicable terms and law.
Provisions that by their nature need to continue after termination will remain effective, subject to applicable law. Nothing in this section limits consumer rights or protections that cannot lawfully be waived.
SECTION 16 - DISCLAIMER OF WARRANTIES
General educational information provided through the Services is intended for informational purposes. It does not replace product instructions, safety warnings, or professional advice appropriate to your installation or use.
We do not guarantee that access to our website will be uninterrupted, timely, secure, or error-free.
Product warranties, where offered, are subject to the applicable warranty terms made available before purchase. Manufacturer warranty coverage, if applicable, depends on the manufacturer’s terms for the particular product.
Nothing in these Terms excludes or limits any express warranty or any consumer rights, implied warranties, or remedies that cannot lawfully be excluded or limited.
SECTION 17 - LIMITATION OF LIABILITY
To the extent permitted by applicable law, OffGrid Wave will not be liable for indirect, incidental, special, or consequential losses arising from your use of our website, including lost profits, lost business opportunities, or loss of data.
This limitation does not exclude or limit liability for fraud, intentional misconduct, gross negligence, death or personal injury caused by negligence, or any liability that cannot lawfully be excluded or limited.
Nothing in this section limits your mandatory consumer rights, applicable product warranties, or rights to refunds or other remedies under applicable law.
SECTION 18 - INDEMNIFICATION
To the extent permitted by applicable law, you agree to reimburse OffGrid Wave for reasonable losses and legal costs arising from third-party claims directly caused by your fraudulent or intentionally unlawful use of the Services, or your knowing infringement of a third party’s rights.
This obligation does not apply to ordinary browsing or purchasing, or to losses caused by our own breach of these Terms, negligence, or misconduct.
We will promptly notify you of any claim for which we seek reimbursement. We will not agree to a settlement that imposes payment or other obligations on you without your written consent.
Nothing in this section limits any consumer rights or protections that cannot lawfully be waived.
SECTION 19 - SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.
SECTION 20 - WAIVER; ENTIRE AGREEMENT
Our failure to exercise or enforce a right under these Terms does not, by itself, waive that right.
These Terms and the policies expressly referenced in them form the agreement governing your use of the Services. For purchases, this agreement also includes the applicable product description, agreed order details, and any express warranties or commitments made by us concerning that purchase.
Later changes to these Terms do not replace the terms applicable to an existing order, except as required by law or expressly agreed with you.
These Terms will be interpreted in accordance with applicable law. Nothing in this section excludes liability for fraud or misrepresentation or limits consumer rights that cannot lawfully be waived.
SECTION 21 - ASSIGNMENT
You may not transfer your rights or obligations under these Terms without our prior written consent, except where permitted by applicable law.
We may transfer these Terms in connection with a sale, merger, or reorganization of our business, provided that the transfer does not reduce your existing rights or protections. We will provide notice and obtain consent where required by applicable law.
A transfer does not, by itself, release us from obligations owed to you concerning existing orders. Nothing in this section limits consumer rights that cannot lawfully be waived.
SECTION 22 - GOVERNING LAW
These Terms of Service and any separate agreements under which we provide Services are governed by the laws of British Columbia and the federal laws of Canada applicable there.
Nothing in these Terms limits any mandatory consumer rights or protections that apply under the laws of the customer’s place of residence.
SECTION 23 - HEADINGS
The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

You can review the current version of these Terms of Service on this page.
We may update these Terms from time to time. We will post the revised Terms with their effective date and provide notice of material changes as required by applicable law. Where the law requires your consent, we will obtain it before applying those changes to you.
Updated Terms apply prospectively. Unless otherwise required by law or expressly agreed with you, an order remains governed by the Terms in effect when you placed it.
